Local governments must approve or deny a complete single-family building permit within 60 days. If they do not send a written yes or no in 60 days, your complete application is approved by default. If your filing is incomplete, they must tell you why in writing within 15 days and let you fix it. They cannot deny you or add new conditions based on rules adopted after you submitted a complete application. Any shorter local deadlines still apply. You can choose phased permitting in writing, which waives the 60‑day clock for your project.
For construction sites, the state health and environment department must respond within 45 days to a complete stormwater notice. You receive an authorization, a rainfall erosivity waiver, or a denial for coverage under the federal general permit. The 45‑day clock applies only when your notice is complete. This does not change federal permit rules.
You can sign electronically and use mail, email, fax, or courier to prove when you filed or got a notice. When counting deadlines, weekends count but state and federal holidays do not. If a problem must be fixed first and you cannot fix it in time, the local government must deny but allow you to resubmit. You may need to resubmit more than once if issues remain. You do not pay extra local filing fees when you resubmit after a denial under this law.
