You can sue an electric utility for losses from a fire it caused, if you prove it is more likely than not. You can recover both economic and noneconomic damages. You must file within two years of the damage, or within two years of when the injury became reasonably knowable. No claim can be filed more than 10 years after the fire. Punitive damages in these cases are capped at $5 million.
The Kansas State Corporation Commission must hold a wildfire risk workshop by July 31, 2026. It covers state wildfire risks, how utilities are ready to reduce them, and mitigation strategies. It also reviews how utilities could recover mitigation costs. The commission can open a broader investigation or hold more workshops if needed.
