Substitute for HB 2114 by Committee on Agriculture and Natural Resources - Clarifying which structures shall be considered water obstructions and not a dam, increasing application fees for a permit to construct, modify or add to a dam, requiring post-construction permit fees and requiring any licensed professional engineer who conducts inspections required by the act to be approved by the chief engineer or a certified intern engineer who is under the supervision of a licensed professional engineer.

Notice when selling land in dam flood zone

Beginning July 1, 2026, if you sell, subdivide, or transfer land inside a dam inundation zone, you must file a notice with the county register of deeds using set language. If you fail to file, you can be charged inspection costs tied to the dam’s prior hazard class.

Stronger penalties and enforcement for dams

Violations can be fined $100 to $1,000 each. If you do not start fixes within 7 days of notice, each extra day is a new violation. Late or incomplete reports or unpaid fees can also bring penalties. The chief engineer issues written penalty orders, and you can appeal to district court. Most collected money goes to the Water Structures Fund; civil penalties go to the state general fund. The attorney general can ask a court to stop illegal dam work or stream changes.

Higher dam permit and post-build fees

Application fees to build, modify, or add to a dam are higher. Fees now vary by hazard class and watershed size, and a post‑construction permit fee also applies. The chief engineer will set the detailed fee rules. If a dam is later moved to a higher hazard level, the owner does not owe fees above the prior schedule just because of that reclassification.

New rules for dams and permits

The law updates what counts as a dam and which stream areas are regulated. Some small or rural projects no longer need a permit: cross‑section changes under 5% within 25 feet; certain non‑dam obstructions outside cities; and projects the chief engineer finds have minimal impact using aerial or topographic data. For safety, the chief engineer can still require a permit even if an exemption would apply. These changes shift who needs permits and who is exempt.

Regular dam inspections and safety checks

Dams are inspected on a set schedule: Class C every 3 years, Class B every 5, and Class A every 10. Any dam marked unsafe must be inspected every year until fixed or removed. The chief engineer, a licensed professional engineer, or a supervised certified intern can inspect. Owners may pay for their own inspections, and a written report is due within 60 days. If mapping shows only land would flood, some inspections can be waived; the chief engineer may enter property with 7 days’ notice, or immediately in emergencies. The department posts dam inundation maps online and shares them with counties; updates happen as funds are available.
