Clear notices and penalties on record-filing offers

If a private company asks you to pay to file with the government or get public records, it must give clear notices. The offer must state, in the same language, “This is an advertisement,” “not from any government agency,” and “You are not required to pay or act.” If written or electronic, that statement appears at the top in at least 24‑point type. Mailed envelopes must say “THIS IS NOT A GOVERNMENT DOCUMENT” in 24‑point, all caps. The company must list its name and street address and tell you where to file directly with the secretary of state or get copies yourself. They cannot use forms, dates, or language that look official or suggest you have a legal duty. Breaking these rules is a deceptive act under the Kansas Consumer Protection Act, and you do not have to prove a purchase to seek remedies. These rules do not apply if you contacted the company first or if it is marketing to a current or former business customer.
