Cleanup shield for Johnson County Army sites

If your nonresidential property in Johnson County was once owned by the U.S. Army, and the Army applied legally registered pesticides at or near structures before 2005, the state cannot order you to investigate or clean up that contamination or make you pay for it. This shield only lasts while the site stays nonresidential. If you convert it to homes or a day care, you must pay investigation and cleanup costs. If you sell the property, you must add a deed notice about the possible pesticides. The notice stays on future deeds until the site is cleared to residential levels or shown not to exceed them.

Responsible parties must pay cleanup costs

The law keeps the normal rule: People responsible for hazardous releases must pay for investigation and cleanup. If the state pays first, the responsible party must repay those costs. The state can take unpaid costs to court to recover them. The law updates and repeals older cleanup statutes to align with these rules.
