Travel cost payback for sheriffs

Except where another law says otherwise, sheriffs get paid back for travel and board costs when serving under a Governor’s requisition. This covers only those specific duties.

No sheriff fees for protection orders

The sheriff cannot charge to serve, execute, or return papers in protection-from-abuse, stalking, sexual assault, or human trafficking cases. This applies starting July 1, 2013. It lowers the cost to get and enforce these orders.

No service fees for governments

The State of Kansas and its cities and towns do not pay sheriff service fees in civil cases where they are a party. This removes those fees for government litigants.

Sheriff service fees and rules

From July 1, 2012 to June 30, 2013, the sheriff charges $10 to serve and return court papers. On and after July 1, 2013, the fee is $15. The fee also applies to failed attempts. If returns are missing or late under K.S.A. 60-312 or 61-3005, no fee is charged for the follow-up processes to fix that. But if a return shows no service because no one can be served or there is no such address, an alias summons at that address still has a fee. One fee covers several papers handled at once for the same person, or for different people at the same address, in the same case. All case fees can be paid in one check or money order. "Process" includes any summons, pleading, writ, order, or notice. These rules replace the older section they repeal.
