Limits on Patrol members’ side jobs

Patrol members cannot hold other elective or appointive offices, with narrow exceptions for military service, some nonpartisan city roles, and boards the superintendent requires. Members cannot take pay from Kansas liquor or racing licensees or their affiliates. They also cannot take jobs that require using state equipment or wearing the patrol uniform. Rewards or gifts tied to duties are banned unless the superintendent gives written permission.

Highway Patrol hiring and promotion rules

The superintendent appoints other patrol officers under civil service and budget rules. To be appointed as an officer (not superintendent), a person must have at least five years of service in the patrol as an officer or trooper. To be hired as a trooper, you must be a U.S. citizen, at least 21, and have no felony conviction. You must be fingerprinted with local, state, and national checks. You must have a high school diploma or equivalent and be medically fit, certified by a physician chosen by the superintendent.

Highway Patrol leadership changes and protections

The law places the superintendent, assistant superintendent, and majors in the unclassified service. All other patrol staff are in the classified service with civil service protections. The governor appoints the superintendent, and the Senate must confirm before the superintendent can use the office’s powers. The governor sets the superintendent’s salary. The superintendent picks the assistant superintendent from current patrol members; the assistant serves at the superintendent’s pleasure. The assistant’s salary is set by the superintendent and approved by the governor. If a patrol member serves as superintendent, assistant superintendent, or major and later leaves, they return to a permanent rank no lower than the rank they held when appointed. If that rank is full, a temporary extra spot is created until a vacancy opens. These changes take effect upon publication in the statute book.
