Kansas tightens its state affordable housing tax credit awards. For the 2025 plan year, KHRC can award up to $25 million. For plan years 2026 through 2028, awards are limited to $8.8 million each year. On and after November 15, 2025, KHRC cannot take applications or award credits to developments that use the 4% federal credit; projects that got a 4% allocation on or before November 14, 2025 keep their credits through the allowed period. KHRC continues to award credits to 9% federal credit projects for 2026–2028, and no new awards are allowed after the 2028 plan year. The law also repeals two prior housing tax credit statutes.
Kansas now offers a transferable tax credit for cash investments in approved housing projects. You can sell or split the credit to anyone, and buyers can use it starting in the year of the original investment. Credits are not refundable, carry forward up to four years, and count as tax paid for certain corporate tax rules. Total credits are capped at $13 million each year, with at least $2.5 million for the smallest counties, at least $2.5 million for mid‑size counties, and up to $8 million for counties with more than 25,000 up to 75,000 people; unused cap can roll to the next year. Per‑unit caps are $35,000 (≤8,000 people), $32,000 (>8,000–≤25,000), or $30,000 (others), with a 40‑unit per‑project, per‑year limit; rules apply starting tax year 2022.
