In residential eviction cases, the court considers mediation unless it would not help or is impracticable. If the parties take part in mediation, the court must delay the case for up to 14 days from the mediation order.
Public housing authorities may request your eviction judgment history for the past three years if you are an active applicant for federal housing help. They must follow federal rules when accessing and using this information.
You can get an eviction judgment expunged after three years if you paid any money owed and had no new eviction in that time. If you got another eviction within three years, the older case must wait until the newer one is eligible. A case with unpaid money cannot be expunged unless both you and the landlord agree. Expungement does not erase any debt, and the landlord can still sue for unpaid sums within the time limits.
Renters in covered cases can file to expunge an eviction online for free using the case number. You must serve the landlord by return receipt delivery. The landlord has 30 days to object; if they do, the court holds a hearing. If there is no objection, the court decides without a hearing and presumes any money judgment is satisfied. A standard expungement form is provided by the Judicial Council.
