Racetracks shielded from nearby nuisance suits

The law gives Kansas racetracks immunity from nuisance, taking, or similar civil claims. It applies only when the track was in Kansas before you bought your property or before you built on it. You are a “surrounding property owner” if your land is within five miles of the track. A “racing facility” includes the track, spectator areas, garages, and grounds used to run races. The law takes effect when it is published in the Kansas statute book.

Narrow exceptions let neighbors sue

You can still sue a racetrack if it materially violates state or local law or breaks a permit condition. You can also sue if the track held no competitive race in the four years before you bought your property. The immunity only blocks nuisance, taking, or similar claims, and it does not stop other civil suits or government enforcement.
