Counties cannot require permits, licenses, fees, or extra conditions to transfer or appropriate water. The state chief engineer and the Water Transfer Hearing Panel control these transfers. Any county rule that conflicts is void, including older ones. Counties may still use zoning or sanitary codes for domestic water wells.
The law repeals K.S.A. 2025 Supp. 19-101a, a county powers statute. This changes the legal basis for some county authority. This repeal does not name any new funding or a start date.
