The court must set a secured bond at set minimums when an affidavit shows the person was on probation, parole, postrelease supervision, or bond for a prior felony during the new felony, and their criminal history score is A–E. Minimums are $50,000 for person felonies level 7–10 or drug level 4–5; $100,000 for person level 4–6 or drug level 3; and $250,000 for person level 1–3 or drug level 1–2. A magistrate may lower the bond only after a hearing and a finding, by a preponderance of the evidence, that the person is not a public-safety or flight risk. The court may change bond without that hearing only if both sides agree, but it cannot allow release on recognizance by agreement.
Judges cannot give a shorter sentence if they find the new felony happened while the person was in custody, on probation, in community corrections, under a suspended sentence, on parole, or on postrelease supervision for a prior felony. The only exception is when both the prosecution and defense jointly recommend the departure. For consecutive sentences, jail days that apply to more than one case count only once. The court may assign those days to one case or split them. Beginning July 1, 2026, this rule applies to sentences pronounced before, on, or after that date, and to credit calculations pending or filed on or after that date.
