The law sets minimum professional liability limits of at least $500,000 per claim and $1,500,000 per year for new or renewed policies. For APRNs, these minimums apply on and after January 1, 2028. An APRN is not subject to these minimums when the initial surcharge to join the healthcare stabilization fund is more than 15%.
Beginning January 1, 2028, advanced practice registered nurses count as healthcare providers under this law. New APRNs get six months to meet membership requirements. The fund’s board of governors also adds one APRN seat. The insurance commissioner appoints the APRN from nominees approved by the Board of Nursing.
Licensed physical therapists can run simple capillary point‑of‑care tests, like lactate and blood glucose, to guide therapy. Tests must be CLIA‑waived and performed by fingerstick only, not by venipuncture or imaging. Clinics must hold a CLIA certificate of waiver and follow the maker’s instructions and training. PTs cannot bill insurers for the test as a stand‑alone service, but may charge patients for reasonable supply costs. PTs must get written consent that shows the cost and states the patient’s financial responsibility. PTs may not use these tests to diagnose conditions outside physical therapy.
The law repeals K.S.A. 40-3402, 40-3403, and 2025 Supp. 40-3401. The practical effect depends on how those repealed sections were replaced elsewhere in the act.
