The City of Eudora and Eudora Township must pass a joint resolution so district voters elect the library board. Elections are in odd-numbered years. The resolution sets when terms start, limits terms to four years, and may stagger first terms. Vacancies are filled by appointment for the rest of the term. The board has five directors, and each must be a qualified voter. Current appointed members keep serving until successors are appointed and elected. Directors are unpaid but can be repaid for actual and necessary expenses. Prior Eudora library statutes are repealed, and the joint resolution must be filed with the county clerk.
The law lets a library or library district put board elections on the ballot. A petition signed by at least 25% of qualified voters in the service area also forces a vote at the next general election. The petition or resolution must say how many members there are, if they are elected at-large or by districts, and whether elections happen at an annual meeting or the general election. If voters approve, the board sets any member districts and staggers the first terms so no more than a simple majority is up at once. Later terms are four years and start January 1 after the election. All board elections are nonpartisan. Qualified voters are people who live in the city for city libraries, or in the district for district libraries created under state law. Voters or the board can also later switch back to appointed members using the same ballot process. This process does not apply to several types of libraries created under other Kansas laws, including the Johnson County Library.
