The law creates the Kansas broadband revolving fund in the state treasury. Money comes from user fees, state appropriations, interest, public or private contributions (including federal), and transfers from the state highway fund. KDOT can spend the fund to plan, build, repair, and maintain the conduit system and to pay admin costs. KDOT can also transfer money between the broadband fund and the state highway fund. Beginning July 1, 2026, by the 10th of each month, interest based on the fund’s average daily balance and the state portfolio rate moves from the state general fund to the broadband fund.
The Kansas Department of Transportation (KDOT) can plan, build, and maintain a statewide conduit system for fiber broadband. KDOT can sign agreements with public or private groups to install equipment or use space when KDOT does not need it. Anyone installing or using the system must get a highway right‑of‑way permit. Using the system is optional, and only users pay the system’s fees or costs.
KDOT sets a fee schedule for entities that install equipment in or use the conduit system. Fees must cover KDOT’s actual extra costs to run, build, and maintain the system. KDOT also sets a policy to decide who gets space and creates standard terms for all agreements.
