Kansas courts must use the factors in K.S.A. 8-1567(j) to decide if a past out-of-state, city, or county DUI law matches Kansas DUI laws. This decision controls whether prior DUI convictions, diversions, or juvenile cases count in a person's criminal history score. The rule applies to acts described in K.S.A. 8-2,144 and 8-1567. The act also repeals the prior version of the criminal-history scoring statute, effective on publication in the Kansas Register. Results can be tougher or lighter for a defendant, depending on how the prior offense compares.
