Students who live in a district and attend a virtual school, a private/nonpublic school, or the Kansas Academy of Mathematics and Science can join district activities run by the state activities group. They must meet K.S.A. 72-6262 before taking part, follow age and eligibility rules that do not conflict with this law, and pay the same fees as others. They must seek participation at the school tied to their home address. Kansas Academy students seek participation at the district school tied to the program’s designated college. These students get the same rights and must follow the same rules as other participants. Districts and the activities association cannot treat them differently because of enrollment status. The law repeals the prior version of this section and puts these rules in place.
If a student leaves a district school and then enrolls in an accredited private, nonpublic, or virtual school, they are not immediately eligible for full participation in district activities. An exception applies if the student was fully eligible on the day they withdrew and participates at the school they left. District and activities association policies may still allow limited participation.
A home-schooled student meets academic rules by making normal progress and having a parent, teacher, or program send an affidavit or transcript to the activities group. Once sent, the student stays academically eligible for that activity season. A virtual-school student does not have to take a minimum number of district classes to join. A board may require a certain course only if all other participants must take it. All students must follow the same tryout and selection rules as everyone else.
