Companies hired to run the scrap metal database cannot charge dealers or force extra contracts. Dealers do not pay to send data, including electronic submissions. Dealers are not civilly liable if the state or its contractor mishandles the data they submit.
The Attorney General runs, administers, and enforces the scrap metal theft law. The office can hire agents, contract, spend funds, license and discipline, investigate, issue subpoenas, keep statistics, and do education and outreach. Kansas law enforcement officers can investigate violations and must send reports to the Attorney General when an investigation ends, even if no local action is taken. The Attorney General can adopt rules to carry out the law. Each year by February 1, the Attorney General submits an enforcement report to legislative leaders and judiciary committees. The law repeals K.S.A. 2024 Supp. 50-6,109a.
The KBI establishes and maintains a central database for required scrap metal information. It was to be set up by July 1, 2020 and kept current. The data is confidential, not a public record, and exempt from the Kansas Open Records Act. It is used only for criminal investigations, evidence, or analysis, and released only to law enforcement for an official investigation. The information may be shared with the Attorney General.
The law creates two state funds: a Fee Fund run by the Attorney General and a Data Repository Fund run by the KBI director. Money from fees, charges, and penalties goes to the Fee Fund and, when appropriated, pays for administration and enforcement. The Attorney General may transfer money from the Fee Fund to the Data Repository Fund, with certifications sent to state accounting, budget, and legislative research officials.
