The Supreme Court Nominating Commission is now a public body under the open meetings law. Its meetings are open, and it may close a meeting only to discuss sensitive financial details in a candidate’s personal records or official background checks. The commission’s records are public, including the names and cities of nominees for the commission or its chair. Background check reports and sensitive financial information for judicial applicants or nominees may stay confidential. No rule by the commission or the Kansas Supreme Court can block release of commission records. The prior version of K.S.A. 20-123 is repealed and replaced with these rules, effective upon publication in the Kansas Register.
