3 provisions identified: 2 benefits, 0 costs, 1 mixed.
Louisiana requires court orders for pen registers, trap-and-trace devices, and cellular trackers, with an exception for communications service providers. Device use must follow the order and relate to an ongoing law-enforcement investigation. Intentional violations carry up to $5,000 in fines, one year in jail, or both. Bail enforcement agents who intentionally misuse devices also face special penalties. A first conviction brings a fine up to $2,500 and a six-month suspension of the bail bond producer license. A second or later conviction permanently revokes that license.
Sureties, which guarantee bail, can file a motion and sworn statement asking for a warrant for a defendant jailed elsewhere. This applies when the defendant is jailed in another Louisiana parish or a foreign jurisdiction. The bail obligation must remain in place, and the court handling it must not have already issued a warrant.
Licensed bail agents seeking to arrest defendants or secure their surrender can seek court orders for cellular tracking. A commercial surety must back the defendant's bail. A bench warrant must also be issued because the defendant missed court. Approved agents must put all information gathered through the court-ordered investigation into the court record.
