Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

Louisiana schools must track excess capacity

Louisiana school boards must set policies to track and address excess school capacity, with separate standards for K–8 and grades 9–12. Measures must include enrollment and student population forecasts, seats available for school programs, and building-use targets. Superintendents must report by November 15 each year using the latest enrollment data. Excess-capacity status lasts until a later report finds it has ended. Recommendations for the next school year must consider academic standards. They are due by December 15, or at the charter renewal presentation if earlier. Superintendents can implement them unless two-thirds of the full board rejects them within 30 days after submission or by December 31, whichever comes first.

Excess capacity limits new school openings

While a district has excess-capacity status, no new school can open for the affected grade levels. Changing an existing school's operator because the prior operator failed district academic standards does not count as opening a new school. Boards can also end charter contracts early to address excess capacity, consistent with district policy. These rules limit school openings and allow existing charter schools to close before their contracts expire.

Orleans can withhold vacant charter facilities

Orleans Parish can get an exemption from offering school property to charter groups for lease or purchase. The exemption applies when a school building is vacated while excess-capacity status is in effect. The superintendent must recommend the exemption, and a majority of the school board must approve it. This limits charter groups' access to vacant facilities.
