Sex-offense victims can request privacy protections

Victims of sex offenses covered by Louisiana law can ask public bodies to protect their personal information. Requests must include, as applicable, a police report, protective order, or final judgment showing victim status or alleged victim status. Public bodies must acknowledge requests within five days, in writing by certified mail or email. They must take reasonable steps to keep the information from being published. Information published before the request must be removed within 72 hours after acknowledgment, or the body must explain non-removal in writing.

Sex-offense victims gain protection against dangerous disclosures

The law bans knowingly publishing a sex-offense victim’s personal information when the publisher knows or reasonably should know it poses an imminent, serious threat. This ban applies when publication results in assault of any degree, harassment, trespass, or malicious destruction of property. A violation is a misdemeanor carrying up to 18 months in prison, a fine up to $5,000, or both. Public bodies are exempt from these and other penalties under this provision.
