People breaking safety-zone rules face penalties

People told that a temporary protection zone exists face criminal penalties for breaking its rules or lawful police enforcement orders. Wrongful use of public property carries a fine up to $500, up to six months in jail, or both. Violations involving serious bodily injury or property damage exceeding $5,000 carry up to five years in prison at hard labor. Violations involving someone’s death carry up to 21 years in prison at hard labor.

Local safety zones limit access temporarily

Louisiana parish presidents, mayors, sheriffs, police chiefs, and chief executives of local government units can create temporary protection zones for public safety. Zones can restrict access or activities on highways, shorelines, waterways, or other areas within the official’s jurisdiction. A written proclamation must explain the need, clearly define boundaries, and state the rules and starting date and time. Officials must require prompt, broad publicity and file the proclamation with the clerk of court. Each zone lasts only as long as needed for security, up to 72 hours from issuance. Officials can create another zone after one expires if public safety still requires it. Officials cannot use this authority in ways that conflict with Louisiana law R.S. 40:1796.
