Stronger child privacy, tighter family evidence access

Louisiana child advocacy centers and child abuse investigation teams must adopt and follow written privacy policies. Centers’ policies must follow state and federal law. Teams can obtain information needed for official duties from public agencies, including confidential or privileged records. Case information they create, receive, or keep is confidential, including interviews, medical records, counseling records, and team work papers. The protections cover agencies and people working under formal team agreements. The law generally blocks access through public-records requests, subpoenas, and court evidence requests. Team members and center staff may share information only as needed for investigation, assessment, prosecution, or treatment. Courts may receive protected information under a protective order limiting its use and sharing. In custody, civil, and administrative cases, records other than forensic interviews are protected from disclosure. A judge may release forensic interviews to attorneys of record only after private review and under a protective order. Criminal cases and proceedings under Children’s Code Titles VI, VII, and VIII remain governed by separate rules. The law preserves police authority, defendants’ constitutional rights, and disclosure of independently obtained evidence.
