Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Schools must support provider-led student care

Health providers must have the required professional credentials and work within their authorized scope; unlicensed school staff cannot decide care needs. Schools cannot ban on-campus evaluations to establish medical need or authorized treatment plans to provide needed care. Schools and health centers must coordinate visits around medical needs, provider ethics, school operations, class time, and testing. Governing authorities must publish policies wherever services are available, without burdensome hurdles that delay care; missing policies cannot block services. Schools cannot demand another background check from properly credentialed providers in good standing who document passing a Louisiana State Police check.

Students gain school health access protections

Louisiana schools, including charter schools, cannot block available, medically necessary primary or behavioral health services when the required consent is given. A parent or guardian must consent for a minor; an adult student can consent for themself. Parents and guardians can withdraw consent at any time. Services can come through school clinics, mobile units, or other provider arrangements. The law does not require schools to create or provide these services, and it adds no funding or insurance coverage.

Students gain school health privacy protections

School health centers can share only nonclinical information needed to coordinate care, protect students, or meet legal requirements. A separate release form is not required for this coordination, but health and student-record privacy laws still apply. Centers do not have to sign agreements that require sharing protected health information.
