Insurance Rate Reviews Can Change Premiums

Louisiana applies the same insurance rate standards in competitive and noncompetitive markets covered by its rate-regulation rules. The commissioner must reject rates found excessive, too low, or unfairly discriminatory. A rate or its expense allowance is excessive when unreasonably high compared with the coverage or services provided. The commissioner can order refunds for excessive or discriminatory charges, or require additional premiums when rates are too low. Rate calculations can use actuarial standards and other relevant factors; risk classifications cannot use race, color, creed, or national origin.

Clearer Home and Auto Insurance Renewals

Louisiana home and private passenger auto insurers must prominently show the previous policy’s premium near the renewal premium. This comparison rule excludes excess and surplus lines policies. Insurers must also disclose all available insurer-defined premium discounts when coverage starts and at every renewal. Discount notices must be written in at least 12-point type; electronic delivery is allowed. Failure to disclose discounts does not give policyholders a private right to sue.

Public Gets Access to Insurance Filings

Insurance rate filings and supporting materials become public after the required notice period ends or when a filing is disapproved. The commissioner decides which confidential, trade-secret, or proprietary materials remain private. Before releasing materials marked as protected, the commissioner must notify the insurer or filer of the request and decision. The filer has 10 days after receiving notice to request an administrative hearing, which pauses the disclosure decision. Courts can review protected documents privately where applicable.
