New $2,000 charge for qualifying convictions

People convicted of listed crimes, including those pleading guilty or no contest, must pay a one-time $2,000 assessment. Covered crimes include specified domestic-abuse and dating-partner batteries, rape, sexual battery, human trafficking, and child sexual exploitation. The charge is added to fines and does not reduce fines or forfeitures. Courts must order payments based on financial ability for people found indigent and unable to pay at conviction.

Survivor fund supports crime victim services

Louisiana renames the Exploited Children’s Survivor Special Fund as the Survivor Special Fund. It supports services and treatment for adult and child victims of trafficking, domestic violence, and sexual assault. Spending requires legislative approval. The law assigns 25% to qualifying child advocacy centers serving children harmed by sexual abuse, physical abuse, neglect, or trafficking. Another 25% goes to the state domestic violence coalition for member programs offering community services and shelter. Accredited Louisiana sexual assault crisis centers receive 50% to serve victims of sexual assault and exploitation. The Governor’s Office of Human Trafficking Prevention may retain up to 10% for necessary fund administration. In covered sex-crime forfeitures, proceeds first pay sale costs, court costs, and storage fees, then victim restitution. The fund receives 50% of what remains; other fine and forfeiture distributions stay unchanged unless the law expressly provides otherwise. The treasury fund also receives legislative appropriations, required assessments, and related interest, after required state bond payments, and faces public audits.
