Louisiana workers’ compensation insurers can collect audit-based premiums only after giving businesses written notice within 90 days of audit completion. Notice must come by certified mail, commercial courier, or electronic transmission. Insurers generally cannot finish or change an audit more than three years after the policy period ends. Exceptions cover misrepresentation or missing relevant information during a prior audit, business noncompliance with an audit, or a business-disputed audit. Fraud-related changes or reviews and court-ordered reclassifications also qualify for exceptions. Insurers may return premiums when an audit shows the business is owed a refund. These rules do not apply to self-insurance funds.
