More online privacy for officers and judges

Louisiana extends personal-information protections to current law enforcement officers and current or retired administrative law judges. The law covers public internet posts that lack a legitimate political, economic, or societal interest. It also covers posts intended to intimidate or harass a protected person. The definition of covered posting no longer requires the person to request protection first.

Fewer privacy enforcement options for protected officials

Protected people can ask only public bodies—not third parties—to remove or stop posting their personal information. The judicial administrator’s office and Louisiana District Attorneys Association can act for the groups each is authorized to represent. Court actions seeking an order to enforce these protections are also limited to public bodies. Reasonable attorney fees remain available, but damages for losses caused by third-party violations are no longer available under this provision.
