Pay and workplace protections for school employees

Louisiana's School Employee Bill of Rights protects public school employees' pay, safety, and workplace respect. Hourly wages or annual salaries cannot fall below the previous school year's amount or be cut during an academic year. Employees have rights to additional pay, including substitute-teacher pay, as provided by existing laws and applicable local rules. Existing laws govern protection from frivolous lawsuits, qualified immunity, and school-board legal defense and payment of covered legal costs. Required job training must be completed and documented before employees perform those duties. Medical procedures and medication duties require the safeguards and records required by state law. Employees also have rights to professional development, career advancement, and freedom from excessive paperwork beyond lawful documentation requirements.

School staff gain stronger discipline protections

Louisiana public school staff can discipline students who break rules or disrupt learning, while following adopted school-board policies. Principals and administrators cannot block, discourage, or punish staff for taking or recommending discipline that follows those policies. School boards cannot adopt policies blocking these employee rights, and administrators cannot retaliate against employees for using them. The rights protect professional judgment and employee input but do not override state law or applicable state and local policies. Each city and parish school board's discipline review committee grows from 16 to 17 members, adding a paraprofessional elected by peers.

Schools must share employee rights notices

Louisiana public school boards must give employees the rights notice at each school year's start and provide copies to parents or guardians. Copies must use a board-approved form or method, with prominent postings in each school and administrative building. Boards and schools that maintain websites must also post the rights online. Boards need not buy displays with their own funds; they must accept donated money or displays to obtain them free. The State Board of Elementary and Secondary Education must adopt rules to carry out the law.
