Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Auto medical benefits escape lawsuit limits

For Louisiana lawsuits filed on or after January 1, 2026, auto insurance medical-payments benefits stay outside these medical-expense rules. This exception covers benefits received through an automobile liability policy with medical-payments coverage. The law does not set a specific recovery amount for those benefits. The medical-expense rules also exclude medical malpractice cases under the listed Louisiana malpractice laws.

Patients face lower medical lawsuit recovery

These Louisiana rules apply to lawsuits filed on or after January 1, 2026, not earlier filings. For health insurance payments to contracted providers, recovery covers actual payments plus patient copays, deductibles, and other cost sharing paid or owed—not billed charges. Contracted providers include in-network providers with negotiated rates and participating providers paid by Medicare. The law removes the extra recovery of 40% of the gap between billed and paid amounts. Medicaid-paid expenses follow the same actual-payment-plus-cost-sharing limit. When a patient's lawyer arranges a discount accepted as full payment, recovery covers actual payments plus applicable patient cost sharing. For expenses outside the insurance and Medicaid rules, recovery includes amounts paid for the patient and amounts still owed, including secured debts. At trial, the judge or jury must hear both billed and paid amounts for past medical expenses.
