Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Water district workers can get benefit support

Public water supply district boards may help pay for employees’ hospital, medical, life insurance, or similar benefits. Boards are not required to offer or fund a plan. Insurance contracts must be competitively bid at least every three years and awarded to the lowest and best bidder.

Some water districts need fewer approving votes

Dissolving a water district normally requires approval from two-thirds of voters voting on the question. The law allows three-fifths approval when four-fifths of directors voting and the circuit court approve the lower threshold. Immediately before board action, the district must have an unresolved Department of Natural Resources enforcement action resulting in an administrative consent order under Missouri chapter 640 or the federal Safe Drinking Water Act. The option excludes counties with 11,001–12,499 residents and a county seat with 4,001–4,999 residents. It also excludes counties with 7,001–7,999 residents and a county seat with 1,001–1,999 residents. This eases approval of dissolution but reduces the voter support needed to authorize it.

Water district closures require service safeguards

Missouri water district dissolution petitions require a $50 cost deposit. Each subdistrict must supply signatures from one-fifth of registered voters or 50 registered voters, whichever is less. The petition must explain why continued operation harms public welfare and safety and identify a better water supplier. Petitioners must prove a board-approved asset sale, subject to court and voter approval, ensures full debt payment and continued water service. Otherwise, the court dismisses the petition at the petitioners’ cost; the ballot must name the buyer that will supply water. Voters and landowners can file objections at least five days before the hearing. Dissolution cannot become final until all debts are paid. The court may send leftover funds to local schools, divided by each school district’s share of water customers.
