Beginning August 11, 2025, New Jersey bans deceptive marketing by licensed or approved substance use treatment facilities and recovery residences. Recovery residences are state-licensed boarding houses offering sober housing, but no clinical treatment, for people with substance use disorders. Ads cannot mislead people about network status, identity, contact details, websites or website redirection, services, or location. Providers and residences need another facility’s express written consent before claiming ties to it. Marketing must give accurate, complete details in plain language about service types, methods, and locations. It must list the entity’s name, brand name, phone number, mailing address, and business address. Each violation can bring a civil penalty of up to $20,000. People harmed by a violation can sue for three times their damages, plus reasonable attorney’s fees, filing fees, and costs. The Department of Health can investigate treatment providers; the Department of Community Affairs can investigate recovery residences. These agencies can impose penalties or suspend or revoke applicable licenses or certifications.
