New qualifications for public works workers

New Jersey public works contractors must certify and document that each journeyperson craft worker meets a training or experience requirement. One path requires completing a registered apprenticeship with standards equivalent to a federally registered program and actively working in that trade. The other requires four years of craft work, verified through pay records or sworn statements from the worker and employers. Union members working under labor agreements used to set prevailing wages are exempt. Workers are also exempt under federally recognized union agreements providing joint labor-management apprenticeship, training, pension, health, or other employee-benefit funds. The Labor Commissioner can consider other relevant proof of qualifications. The law takes effect one year after enactment.

Contractors face stricter apprenticeship program checks

New Jersey public works contractors must document that their apprenticeship programs meet state requirements and federal registration and training standards. The Labor Commissioner can find that a program fails federal standards. Contractors relying on that program can face registration denial, renewal denial, suspension, or revocation. One failing program can affect several contractors, limiting their access to public works contracts. Contractors retain their right to request a hearing before enforcement is finalized under the existing procedures.
