New Jersey requires covered health plans and Medicaid to cover biomarker tests, which check genes, proteins, or other biological markers. Testing must help diagnose, treat, manage, or monitor a disease or condition; screening people without symptoms is excluded. Coverage requires support from FDA test or drug indications, FDA drug-label warnings, Medicare coverage decisions, or nationally recognized clinical guidelines. Private plans keep their usual medical review and copays, deductibles, and coinsurance; Medicaid charges no cost-sharing for these tests. Plans must avoid unnecessary repeat biopsies or samples while allowing repeats needed for care. Reviews must follow state guidelines and deadlines, and patients and treating providers must get clear, accessible instructions for appealing denials. Medicaid testing contractors must provide the same scope, duration, and frequency of testing as Medicaid itself. The law takes effect July 22, 2025, and applies to covered policies and contracts delivered, issued, executed, or renewed from that date, including those approved for issuance or renewal. For certain plans, coverage depends on the insurer having reserved the right to change premiums.
