Beginning November 13, 2025, commercial farmers can recover reasonable defense costs and attorney fees in qualifying Right to Farm cases. They must win because their farm operation, activity, or structure has the Act’s conclusive legal protection. The county board or committee must find that the complaint was more likely than not brought in bad faith. Farmers must apply to that board or committee and detail their defense costs and attorney fees. The board or committee decides which amounts are reasonable and must order the complainant to pay those amounts.
