Effective March 6, 2025, eligible victims can seek pain-and-suffering damages from New Jersey public bodies or employees. They no longer need to show permanent injury, disfigurement, or dismemberment and medical treatment expenses above $3,600. Covered claims involve sexual assault, other sexual crimes, prohibited sexual acts, or sexual abuse. Government immunity does not block these claims when willful, wanton, or grossly negligent conduct caused the harm. For victims under 18, claims against public bodies also cover negligent hiring, supervision, or retention of public employees. Filing deadlines still apply, including the referenced two-year period for claims otherwise barred by time limits. This law does not establish a new two-year period starting March 6, 2025.
