Real estate agents gain business payment options

Beginning January 12, 2026, New Jersey real estate salespersons and broker-salespersons can form an LLC or another lawful entity to receive commissions or other compensation for covered real estate work. They can receive all or part of that pay from the entity without changing their broker affiliation under their written agreement. The employing or contracting broker must still be licensed in New Jersey and remain the source of that compensation. The law does not allow payments from unrelated sources. The New Jersey Real Estate Commission must create a registration process for entities receiving this compensation.
