Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Rent-free housing for eligible resident farmworkers

Beginning May 9, 2025, eligible resident farm employees cannot be charged rent for housing provided under this law. This housing is reserved solely for employees who work full time in agricultural production on that commercial farm. Farm owners, their direct descendants, and full-time, year-round horse-related employees do not qualify under these housing rules. The law does not require farms to provide housing.

Farm housing gains protections and safety requirements

Beginning May 9, 2025, qualifying resident farm employee housing is eligible for New Jersey’s Right to Farm protections. The State Agriculture Development Committee must adopt a housing practice linking housing amounts to the farm’s labor needs. The law sets no housing formula or deadline for adoption. Housing must follow that practice, the State Uniform Construction Code, and applicable Department of Community Affairs standards. It must also meet the Seasonal Farm Labor Act and federal Migrant and Seasonal Agricultural Worker Protection Act. Towns cannot deny or withhold an occupancy certificate for housing that meets these requirements.
