Tougher cyber-harassment penalties protect public servants

The law strengthens protections by making cyber-harassment against public servants or their family members a third-degree crime. Penalties are three to five years in prison, a fine up to $15,000, or both. Public servants include elected officials and people appointed to or employed by New Jersey public entities or their subdivisions. They also include judges, jurors, advisors, and consultants performing government functions. Judges and juries can now infer intent to harass in cases involving any public servant, not just judges. This applies when the accused knew or should have known the conduct targeted or concerned the servant, with a connection to public duties; the inference can be challenged. Other cyber-harassment remains fourth-degree, except when offenders age 21 or older impersonate minors to cyber-harass minors.

More help for New Jersey cyber-harassment victims

New Jersey's Attorney General must lead cyber-harassment prevention and victim assistance, including help for public servants and their families. The work runs through the Division of Violence Intervention and Victim Assistance or equivalent means, not a new separate office. Duties include accessible reporting systems, counseling, legal aid, and education for victims and offenders. The Attorney General must regularly consult law enforcement, legal experts, and technology experts to define cyber-harassment as technology changes. The office must work with social media platforms on stronger content-removal policies and encourage reporting tools and victim support. It must coordinate with education officials on school cyber-ethics classes and with law enforcement on specialized units. Officer training must cover investigations, digital evidence collection, and related procedures. The law appropriates necessary General Fund money to the Department of Law and Public Safety, without setting a dollar amount.
