Retired legislative staff can work longer

Beginning January 20, 2026, eligible retired New Jersey Legislature employees can return to legislative work for up to seven years. They keep their Public Employees’ Retirement System pension without rejoining the system. Employees who returned under the earlier rule can extend their two-year term to seven years from their original return date. Eligible pensions must have been granted before P.L.2021, c.498 took effect or during 2022, 2023, or 2024. The retirement must be genuine, not disability-based, and the employee must have reached their applicable service retirement age when retiring. Work cannot be arranged before retirement and must start at least 30 days after the pension becomes due and payable. Returning employees must work part time, no more than 20 hours weekly; former legislators are not eligible. This option applies only when it preserves the retirement system’s qualified status under federal law.
