New Mexico’s insurance superintendent can issue civil investigation subpoenas before formally notifying someone of planned enforcement action. Investigations must have reasonable and probable cause and concern possible insurance law violations or information useful for enforcement or administration. If someone fails to obey without a lawful excuse, the enforcing authority can ask a district court to order compliance. Affected people must receive reasonable notice before that court request.
