The law applies to covered New Mexico health policies and contracts issued on or after July 1, 2025. Plans generally cannot require prior approval for FDA-approved drugs treating autoimmune disorders, cancer, rare diseases, or substance use disorders. Plans also cannot require patients to try other drugs first for autoimmune disorders, cancer, or substance use disorders. That protection also covers off-label drugs for rare diseases—diseases affecting fewer than 200,000 people nationwide. A health professional in the same or a similar specialty must find the drug medically necessary. The prior-approval and try-first protections do not apply when a generic, biosimilar, or interchangeable biologic version is available. Medical-necessity requests are automatically approved unless denied within seven calendar days after all required documents arrive. The deadline is 24 hours when delay threatens life or overall health, limits recovery of maximum function, or causes severe, intolerable pain.
