Bill Overview

Analyzed Economic Effects

5 provisions identified: 3 benefits, 1 costs, 1 mixed.

Camera accuracy checks and warning signs

Each camera must pass a self-test that day and get a yearly check by an independent lab. Yonkers posts advance warning or speed-limit signs that meet MUTCD standards. Operators must be trained to set up and run the systems. They sign daily logs showing the date, time, location, and that tests passed. The city keeps these logs until the camera is removed or all related cases are resolved.

Defenses and rules for owners and renters

If your car or plates were reported stolen and not recovered, send a certified police report by first-class mail; you are not liable. If you rent out vehicles, you avoid liability when you filed required info and, within 37 days, give Yonkers the correct lessee details and lease info. Then the lessee at the time gets the ticket. If you were not driving, you can seek repayment from the driver. You are not fined if the driver used your car without consent (the law presumes consent), and you can also defend a ticket if the camera system malfunctioned.

Limits on speed camera images

The law limits what the cameras capture and use. Images should avoid showing drivers, passengers, or the car’s interior whenever possible. Photos are used only to send notices and decide cases, are not public, and are generally shielded from discovery except by warrant or judge’s subpoena. Yonkers must destroy images after the case ends or one year after issuance, whichever is later. It also updates state public-records law to classify these images for these limited uses through December 31, 2031.

Yonkers school speed cameras through 2031

Yonkers runs a school speed camera program. The city can use cameras in up to 25 school zones at once. Cameras operate only when school speed limits are in effect on school days and during student activities. The law starts 30 days after it became law and ends December 31, 2031. Yonkers may set rules, hire vendors, and must use competitive bidding to buy or lease the equipment.

How Yonkers speed camera tickets work

You are liable as the owner if your vehicle, used with your permission, is over 10 mph above the posted school limit while that limit is in effect, based on camera images. Each ticket is up to $50; failing to respond can add up to $25. Yonkers mails notices by first-class mail within 14 business days for NY residents, or 45 business days for non-residents. Notices include your info, location, date and time, a camera ID, and at least two time-stamped rear photos showing the same stationary object. The Yonkers Parking Violations Bureau handles these cases; a technician’s sworn certificate based on the images counts as proof, and you can review the photos. These tickets are not a conviction, do not go on a driving record, and insurers cannot use them. If the driver is convicted of the speeding offense in court, the owner is not liable under this program.
