Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Hotel owners must collect the tax

Hotel and motel owners in Gardiner must collect the tax from guests and pay it to the town. The town’s chief fiscal officer runs the tax and can set monthly or other filing periods. Owners may treat the tax as part of the rent and can pursue guests who do not pay. Owners cannot be assessed extra tax more than three years after a return is filed, unless the return was fraudulent or no return was filed. If you dispute a final tax bill or a denied refund, you can ask a court to review it within 30 days, but you usually must deposit the tax or post an approved bond.

New hotel room tax in Gardiner

The law lets Gardiner add a hotel and motel tax up to 5% of the nightly room rate. It applies to hotels, motels, bed-and-breakfasts, and tourist homes. You do not pay it if you stay 90 or more straight days. Government and qualifying nonprofits are exempt. The town must pass a local law to start the tax.

Hotel tax funds town services

All hotel and motel tax money goes into Gardiner’s general fund. The town board can spend it on services, roads, and other needs. The law takes effect now and ends three years after it starts unless extended.
