Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 0 costs, 3 mixed.

Atlantic Beach tax on short stays

Atlantic Beach can charge up to a 3% tax on the nightly price of hotel, motel, and beach club use. People staying in a hotel or motel for 90 straight days are permanent residents and do not pay this tax. The tax can cover hotels, motels, bed-and-breakfasts, and beach clubs by the ocean. The State of New York, the U.S. where immune, and qualifying charities, religious groups, and schools are exempt. Businesses do not get this nonprofit exemption.

Hotels and beach clubs must collect tax

Owners must collect the tax from guests as part of the rent and send it to the village. The village can set how often you file and pay, monthly or on another schedule. The village usually has 3 years after a filed return to assess more tax; there is no limit if no return was filed or if fraud is involved. To challenge a bill or a denied refund, you must act within 30 days and post a court-approved bond or deposit the tax with interest and penalties. The village’s chief fiscal officer administers the tax and can be a required party in collection actions.

Tax money to village general fund

All money from this tax goes into Atlantic Beach’s treasury and into the village general fund. The village can spend it for any lawful purpose. The law is in effect now and the authorization ends December 31, 2029, unless extended.
