4 provisions identified: 1 benefits, 1 costs, 2 mixed.
The law sets 15% yearly interest on oil and gas proceeds that are paid late. Interest runs from the end of the month of sale until the day you are paid. This applies when payors miss the legal payment deadlines. Starts November 1, 2026.
When the late‑payment interest rate is at least 15% a year, this Act is the only remedy for late royalty payments. In court, you can recover the unpaid proceeds and the statutory interest. You cannot get punitive or extra damages unless there is clear and convincing proof of actual, knowing, and willful deceit. Starts November 1, 2026.
After 36 months without payment, payors can send your proceeds and interest to the state Mineral Owner’s Fund, if they have contacted you. The State Treasurer keeps the money in a separate escrow for owners and must keep records. Payors must mail notice to your last known address. Once money goes to the Fund, the payor is released and you claim from the Treasurer instead. Some suspended proceeds must be sent within 180 days after they come due. These proceeds are presumed abandoned at 36 months. Starts November 1, 2026.
Interest is 6% a year when your title is not marketable. It runs from the end of the sale month until payment. No interest is owed while probate stays open, when you ask in writing to suspend, or when a lien is filed. If a mailed check is returned or not cashed after a good‑faith address search, or you refuse an electronic payment, interest stops from that date. Payors must keep copies of mailings, returned envelopes, and checks. Starts November 1, 2026.
