Cities must use open competitive bidding

Beginning November 1, 2026, city councils must set and enforce competitive bidding rules. These rules apply in addition to the Public Competitive Bidding Act. Councils must give notice and a chance to bid for purchases, contracts, and sales of surplus items. Councils cannot exempt any contract from bidding. Any purchase or contract over a council-set amount needs prior council approval. The city manager handles buying for all offices and can move surplus items between departments. The council may assign some or all of that duty to another employee.

Local governments can use reverse auctions

Beginning November 1, 2026, cities, counties, public trusts, and nonappropriated state agencies can buy through online reverse auctions. Bidders compete in real time at a set date and time, with the current low bid shown. Multiple bidders can join, and bidder names stay anonymous during the event. Buyers can require registration and prequalification and can limit bidding to prequalified firms. Award criteria are set by the buyer. Closing times can be extended in the public interest, including for major tech errors, with at least 15 minutes’ notice. All bids are public records, and normal bid protest remedies still apply. The law also repeals older reverse auction sections and replaces them with this statewide process.
