Mental health land sales fund facilities
The law creates a Real Property Trust for the state mental health department. Beginning November 1, 2026, only the specific tracts named in law may be sold, and only if the trustees and the Department agree it is in the Department’s best interest. All sale money goes into the Trust. The Trust may spend it only on buildings, capital projects, or other uses that directly help people the Department serves.
State help to manage trust property
Beginning November 1, 2026, the Office of Management and Enterprise Services helps identify and transfer Department property into the Trust. It also helps lease Trust property when asked. The Commissioners of the Land Office help lease any mineral interests placed in the Trust.
No land sales to fund services
Beginning November 1, 2026, the Department may not sell trust property to pay for prevention, mental health, or addiction treatment services. This stops using property sales to fund ongoing program or operating costs.
