Beginning July 1, 2026, any person or student group harmed by a violation can sue the college and responsible employees. You can seek an injunction, money damages, attorneys’ fees, and court costs. You can also use the violation as a defense or counterclaim. You must file within one year of the violation. Each day a violation continues counts as a new day.
Beginning July 1, 2026, outdoor areas at public colleges are public forums. Schools cannot set “free speech zones” that block speech elsewhere. People may speak, hand out literature, and assemble if the conduct is lawful and not a material, substantial disruption. Schools may use clear, published, content- and viewpoint‑neutral time, place, and manner rules. Spontaneous assembly and handing out literature are allowed.
Beginning July 1, 2026, the Oklahoma Free Speech Committee develops or approves First Amendment training. Deans, department heads, and officials who set policy or handle complaints must take it every two years and when hired or promoted. All first‑year students, including transfers and graduate students, must complete training. The training must cover public‑forum rules, neutral time‑place‑manner limits, what counts as disruption or unprotected speech, examples, academic freedom, diverse views, counter‑speech, complaint and lawsuit rights, and where to learn more.
Beginning July 1, 2026, schools may charge a security fee for expressive events that need a permit. Fees cannot be based on what is said, who is invited, or expected reactions. Fees can be based on time or place, crowd size, or alcohol service. Schools must post the fee criteria on their websites.
Beginning July 1, 2026, colleges must publish free‑speech policies in handbooks, on websites, and at orientation. By December 31 each year, each school must post and send a public compliance report. The report must be reachable within three links from the home page, searchable, and viewable without a login. It must describe incidents or barriers without student personal data. If sued, a copy of the complaint must go to the Governor and Legislature within 30 days.
